TERMS and CONDITIONS

 Acceptance of Terms

            This Terms and Conditions (T&C) agreement is between You, hereinafter referred to as the “User” and TruckersTablet.com, hereinafter referred to as “TruckersTablet”, “Company”, “We” or “Us” and its legal successors and assigns.

            User may not use the Services and may not accept the T&C if User (a) is not of legal age to form a binding contract with the Company, or (b) is a person barred from receiving the Services under the laws of Canada or other countries including the country in which User is a resident or from which he/she avails of the Services of this Website.

            By accepting this Terms and Conditions (T&C) electronically or in writing, and/or by using TruckersTablet’s Services, the User agrees to be bound by the following terms and conditions.   The latter also agrees that his/her electronic acceptance of this T&C shall have the same force and effect as if he/she had agreed to this T&C in writing.

TruckersTablet shall have the right at any time to change or discontinue any aspect or feature of the Website, including, but not limited to, content, hours of availability, and equipment needed for access or use.

            If the User does not expressly reject the T&C, he/she is deemed to have impliedly accepted the stipulations included herein.  The User’s acceptance of the T&C is binding upon all of the TruckersTablet’s services,  including additional accounts at a later date.

Registration Requirements

The Website also allows registration which User can initiate with respect to email newsletter subscription and buying products. 

If  User wishes to subscribe for the email newsletter, he/she may do so by simply signing up and will be entitled to receive newsletters about TruckersTablet’s products and services or any other related information for any given products and services of TruckersTablet.

For the registration requirements, the User will be required by the Website to provide personal information which in the opinion of TruckersTablet, is sufficient to create a valid identification for the User who wishes to register. 

Member Account, Password, and Security

 If any of the Services requires User to register an account, User must complete the registration process by providing his/her name with current, complete and accurate information as prompted by the applicable registration form. User will choose a password and a user name. User is entirely responsible for maintaining the confidentiality of User’s password and account. Furthermore, User is entirely responsible for any and all activities that occur under User’s account. User agrees to notify TruckersTablet immediately of any unauthorized use of User’s account or any other breach of security. TruckersTablet will not be liable for any loss that User may incur as a result of someone else using User’s password or account, either with or without User’s knowledge. However, User could be held liable for losses incurred by TruckersTablet or another party due to someone else using User’s account or password.   User may not use anyone else's account at any time, without the permission of the account holder.

  User Conduct     

User shall use the Website for lawful purposes only.   User shall not transmit through the Website any material which is unlawful, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without the TruckersTablet's express prior approval, contains advertising or any solicitation with respect to any products or services.  Any conduct by a User that in the Company's discretion restricts or inhibits any other User from using or enjoying the Website will not be permitted. User shall not use the Website to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of Users to become subscribers of other on-line information services competitive with the Company.

The Website contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Website are copyrighted as a collective work under copyright laws.   TruckersTablet owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the TruckersTablet and the copyright owner.  

User shall not download on the Website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with User.   User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such. 

The foregoing provisions are for the benefit of TruckersTablet, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Disclaimer

            The use of the TruckersTablet’s products shown in this Website shall be at the risk of the buyer.  To reduce the risk of unsafe operation, please carefully review and understand the user manual that will be provided to the buyer.  It is the buyer’s sole responsibility to use the TruckersTablet products prudently and in accordance with national, federal or state law under which the buyer may be covered.  The products GPS functions are intended to be used only as a navigational aid and must not be used for any purpose requiring precise measurement of direction, distance, location, or topography.  Statistics provided such as trip time are best estimates and may not accurately reflect true conditions.  The Global Positioning System (GPS) is subject to changes which are beyond the control of TruckersTablet, and therefore may affect the accuracy and performance of all GPS equipment. 

When used in vehicles, it is the sole responsibility of the truck owner/operator to place and secure the GPS unit so that it will not interfere with the vehicle’s operating controls and safety devices, obstruct the driver’s view of driving conditions, or cause damage on personal injury in the event of accident.  The GPS unit shall not be mounted in a place where the driver or passengers are likely to be hit by the GPS unit during an accident or collision.  The mounting hardware supplied by TruckersTablet is not warranted against collision damage or the consequences thereof. 

When used in vehicles, it is the sole responsibility of the driver to operate the vehicle in a safe manner, to maintain full surveillance of all driving conditions at all times, and not become distracted by the Tablet GPS system to the exclusion of safe driving practices.  It shall be unsafe to operate the GPS controlling system, access its internet capabilities and its other application features  while driving.    Failure of the driver of the vehicle equipped with the TruckersTablet product to pay full attention to the operation of the vehicle and road conditions while the vehicle is in motion could result in an accident or collision with property damage and personal injury. 

  IN NO EVENT SHALL TRUCKERSTABLET BE LIABLE FOR ANY INCIDENTAL, SPECIAL INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE, OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT. 

             This Website may include technical inaccuracies or other errors, and your use and browsing of this Website is at your risk. THIS WEBSITE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Any activities which User engage in connection with a Linked Site is subject to the privacy policy, conditions of use, and other terms imposed by the operator of the Linked Site and TruckersTablet  disclaims all liability in connection therewith.

            There are some factors, such as one’s internet connection, computer system and other equipment that may contribute to the performance quality of the website.  Due to regular and necessary maintenance, TruckersTablet’s Website is not guaranteed to be absolutely available at all times.  Moreover, it also does not guarantee that there will be no service interruptions when using the aforementioned Website or the links herein available, nor does it guarantee that the same are free of any virus.

Manufacturer’s Warranty

All TruckersTablet’s Tablet PC’s are warranted to be free from defects in materials or workmanship for six (6) months from the date of purchase. Within this period, TruckersTablet. will, at its sole option, repair or replace any components which fail in normal use. Such repairs or replacement will be made at no charge to the customer for parts or labor, provided that the customer shall be responsible for any transportation cost. This warranty does not cover failures due to abuse, misuse, accident or unauthorized alterations or repairs, or damages caused by 3^rd party APPS or software.

Restrictions of Liability

            TruckersTablet excludes any and all terms or statements implied on the website or the links herein provided, unless otherwise expressly mentioned in this T&C Agreement or part thereof, but not any right which by law cannot be excluded.  Also, TruckersTablet will not be held liable for any loss or damage, regardless of cause, kind or nature, suffered by any person or company who uses this Website, unless said liability is a direct effect of something that was expressly agreed on through a written contract, or directly prescribed by law.

Governing Authority

            All transactions, written and verbal agreements that may have occurred in the creation of our Website, its contents or any part thereof, including transactions and agreements thereafter, are governed by the laws of the province of Ontario Canada.

Investigation: Cooperation with Law Enforcement;

TruckersTablet reserves the right, without any limitation whatsoever, to: (a) investigate any suspected breaches of its Website security or its information technology or other systems or networks, (b) investigate any suspected breaches of this T&C, (c) involve and cooperate with law enforcement authorities in investigating any such matters, and (d) prosecute violators of this T&C to the full extent of the law. 

Privacy and Security Measures

TruckersTablet must collect certain information in order to operate this Website and to fulfill User requests or enable participation in certain online activities. But TruckersTablet respects the privacy of its visitors, and is especially mindful of protecting the privacy of young children visiting our sites. TruckersTablet have adopted reasonable security measures to protect against the loss, misuse, and alteration of the personal information under our control. TruckersTablet use encryption technology to protect credit card data during transmission, and adopt careful internal procedures to safeguard this information in our system. Vendors, service providers, and others who help make this Website and our products and services available must sign confidentiality agreements; they are not permitted to use personal information except in connection with their services to TruckersTablet.   Nevertheless, TruckersTablet cannot guarantee complete security of personal information.

Operation of Website; Availability of Products and Services

TruckersTablet controls and operates this Website from its headquarters in Ontario, Canada, and TruckersTablet makes no representation that this Website is appropriate or available for use beyond Canada. If you use this Website from other locations, you are responsible for compliance with applicable local laws. This Website may describe products and services that are available only in Canada (or only parts of it) and are not available worldwide.

Tort Claims and Other Claims

            User agrees to indemnify, defend, and hold harmless TruckersTablet (which includes TruckersTablet’s affiliates and subsidiaries) and its officers, employees, agents, business partners, licensors, and licensees from any damages, liabilities, costs, and expenses (including reasonable attorneys' fees) on account of any claim, suit, action, demand, or proceeding made or brought against any such party, or on account of the investigation, defense, or settlement thereof, arising in connection with the use of this Website.  User further agrees that he/she may only bring claims against TruckersTablet in his/her individual capacity and not as a member of a class.

Termination

Either TruckersTablet or User may terminate this T&C Agreement at any time. Without limiting the foregoing, TruckersTablet shall have the right to immediately terminate User's Account in the event of any conduct by User which TruckersTablet, in its sole discretion, considers to be unacceptable, or in the event of any breach by User of this T&C Agreement.

User may terminate or cancel his User Registration Account by informing the Administrator of TruckersTablet at info@truckerstablet.com.

Period for filing Claims

User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of TruckersTablet products and services or this T&C must be filed within six (6) months after such claim or cause of action arose or be forever barred. The section titles in the T&C are for convenience only and have no legal or contractual effect.

Severability

If any provision of this T&C is deemed unlawful, void, or unenforceable for any reason, then that provision will be deemed severable from the remainder of this T&C and will not affect the validity or enforceability of the remainder of this T&C.
